Data collected through our website and eCommerce platform identifies you by name or other directly identifiable means, including, address, phone number, email, username, password, identification card, medical recommendation, and purchase history in compliance with state and local cannabis laws to verify and limit the sales of cannabis to of-age adults. As set forth below, you have the right to know the information collected and to use our form to request the deletion of such information. Certain information must be retained to maintain our compliance with applicable state and federal laws. Upon our receipt of your request for the deletion of information, we will verify and respond to such a request, identifying the content that we are legally capable of deleting.
Data about the content you view on this website, how you arrived at the site, and your general location is maintained by us and our third-party platforms and analytics partners. This data is used to help understand how our site is used, to personalize your services, and to tailor messaging on our site and across the internet to your perceived interests. You can read more in our Privacy Policy. We will not discriminate against you for the exercise of your privacy rights but some functionality may be diminished if information cannot be retained.

Your Rights and Choices
You have the right to request that Berkeley Patients Group disclose certain information to you about our collection and use of your personal information over the past 12 months. Once we receive and verify your request we will disclose to you:

- Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement if you previously provided informed consent.
- Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
- Comply with a legal obligation (e.g., records audits by licensing agencies).
- Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.
PLEASE NOTE that we DO NOT PERMIT persons under the age of 21 to access our website and those under the age of 21 (or 18 with a valid doctor’s recommendation) to access our premises. To the extent we collect personal information from any person aged 14 to 16 years that information is only collected with the express written consent of the individual. To the extent we collect personal information from any person aged 13 years or fewer, that information is only collected with the express written consent of his/her parent or guardian.
You may only make a request for access or data portability twice within a 12-month period. The verifiable request must:
- Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative. We cannot ask for additional information to verify the request so please be complete in your request.
- Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. We will only use personal information provided in a verifiable request to verify the requestor’s identity or authority to make the request.
We endeavor to respond to a verifiable request within forty-five (45) days of its receipt. If we require more time, we will inform you of the reason and extension period in writing.
Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.
We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
